Privacy Policy

The details provided by the user in the course of using the Website, as well as any data generated based on the analysis of such details, and any information regarding the user that has come and/or may come to the Company’s knowledge במסגרת the use of the Website (collectively, the “User Information”), shall be subject to the provisions set forth below.
The user’s use of the Website and the provision of User Information to the Company constitute the user’s consent that such User Information shall be stored and managed by the Company, and that it may be used for the purposes of operating the Website, providing services to the user, executing and completing transactions, contacting the user, responding to inquiries, internal purposes such as handling complaints and/or reviews, as well as for analysis, monitoring, and the provision of statistical information to third parties (which shall not personally identify the user). The user agrees that such use of the User Information shall not be deemed to constitute any infringement of the user’s privacy, and the Company shall not be considered to have breached any obligation of confidentiality or privacy, nor to have infringed the user’s privacy, by reason of any information that may identify the user or enable tracking thereof.
The user is under no legal obligation to provide User Information to the Company, and the provision of such information is made voluntarily and with the user’s full and informed consent.
The Company shall not disclose the User Information to third parties, except in the following circumstances:
(a) if required to do so pursuant to a court order or applicable law;
(b) if the Company receives notice of legal proceedings initiated against it in connection with actions performed by the user, and in connection with any dispute, claim, demand, or legal proceedings, if any, between the user and the Company;

(g) if and to the extent necessary for the operation of the Website, including the transfer of information to employees, affiliated companies, subcontractors, or other entities (including those located in jurisdictions where the level of data protection differs from that applicable in your jurisdiction) involved in the operation of the Website. The user shall have no claim or demand against the Company and/or its representatives in connection with such disclosure.

If the user: (a) objects to the use of their User Information; or (b) wishes to access, delete, or correct any of their User Information, the user must notify the Company accordingly, and the Company shall act in accordance with such request, subject to applicable law.

Intellectual Property

All intellectual property rights (of any kind whatsoever), including trademarks, trade secrets, and copyrights, whether registered or unregistered, in the Website and any part thereof, including (without limitation) content, design, and any software, application, computer code, graphic file, text, and any other material contained in the Website, whether in the user interface, source code, or object code, are the exclusive property of the Company and/or third parties, as applicable, and are protected by the copyright laws of the State of Israel, international conventions, and the copyright laws of other jurisdictions, as applicable.
Users are prohibited from modifying, copying, publishing, distributing, transmitting, displaying, performing, reproducing, licensing, creating derivative works, reverse engineering, or selling, whether partially or in full, temporarily or permanently, in any manner whatsoever, any part of the information or content contained on the Website, without the prior written consent of the Company and/or the relevant third parties, as applicable. Furthermore, the Website may not be used in any manner that constitutes or may constitute an infringement or violation of the intellectual property rights of the Company or, as applicable, such third parties, without the Company’s prior express written consent.
The trademarks displayed on the Website are the property of the Company or, where published by advertisers or business partners, are the property of such third parties. No use may be made thereof without the prior written consent of the Company or, as applicable, such third parties.

User Obligations

Use of the Website is subject to the following conditions:

The information and content published on the Website may not be used for display on the Internet or any other service without the Company’s prior written consent and subject to the terms of such consent, if granted. The user undertakes not to store information or content from the Website using any software, nor to distribute such information or content publicly, commercially, or for any other purpose.
The user undertakes to use the Website, its information, content, and services solely in accordance with applicable law and the provisions of the Terms of Use.
The user undertakes not to link to the Website and/or use it, or its information, content, or services, for uploading, downloading, distributing, publishing, or transmitting:
(a) any information or material that infringes any rights, including intellectual property rights, privacy rights, or any other proprietary rights;
(b) any information or material that is illegal or prohibited from publication or use, including content that constitutes threats, harm, insults, defamation, racism, or otherwise inappropriate content;
(c) any information or material containing viruses or other software that may damage the Company’s or any third party’s computer systems, or otherwise restrict or prevent others from using the Website; or
(d) any information or material containing advertising of any kind without the Company’s prior written authorization.
The user undertakes not to make any changes to or interfere in any manner with the Website’s source code, information, or content, and not to upload any software or applications that may harm or cause damage to the Website, the Company, or any third parties.
The user agrees that, without prejudice to any other rights of the Company, in cases where the Company reasonably suspects that the user’s use of the Website is inconsistent with the Terms of Use or applicable law, it may suspend the user’s access to the Website services, including by blocking IP addresses, monitoring user activity, providing user activity patterns to relevant authorities and/or third parties who, in the Company’s judgment, have been affected by the user’s infringing activities, and take any other measures it deems necessary to protect its property and/or rights, or the rights of third parties.

Limitation of Liability

Without prejudice to any other provisions of these Terms of Use, under no circumstances shall the Company and/or its representatives be liable for any of the following:
Under no circumstances shall the Company and/or its representatives be liable for any indirect, consequential, or incidental expenses, losses, or damages, including, without limitation, economic loss, loss of profits, loss of business opportunity, loss of reputation, depreciation, or similar, incurred by the user or any third party in connection with the use of the Website and/or any act or omission of the Company and/or its representatives.
The Company shall not be liable for any malfunction, delay, or disruption in the use of the Website, including, without limitation, in telecommunications lines, wired networks, Internet systems, or cellular networks, nor for any loss, expense, or damage arising from causes beyond the Company’s control, including but not limited to government orders or regulations, substantial communication system outages, earthquakes, storms, shortages of materials or public services or transportation services, fire, flood, explosions, accidents, pandemics, strikes, shutdowns, riots, public order violations, war, acts of terrorism, hostilities, or lockdowns. Such events shall not constitute a breach of the Terms of Use and shall not entitle the user to any remedy or claim. For the avoidance of doubt, and without limiting the generality of the foregoing, the user shall have no claim or right in connection with any actions taken by the Company in response to such malfunctions or disruptions.
The Company shall not be liable for any loss, expense, or damage arising from acts or omissions of the user and/or third parties, including, without limitation, communication service providers, whether in connection with temporary or permanent disruptions to communication lines.
The Company shall not be liable for any loss, expense, or damage arising from unauthorized access, attacks, breaches, or intrusions to information (or attempts to perform any of the foregoing) through communication lines or any other network.
The Company shall not be liable for any loss, expense, or damage incurred by the user due to updates, deletion, removal of content from the Website, or temporary suspension or downtime of the Website for reasonable periods for maintenance or upgrades.

Without limiting the foregoing:

The Website may provide links or references to other websites and web pages operated by third parties (hereinafter: “Linked Sites”), where users may, among other things, obtain or purchase various products and services. Users may be requested to register, provide personal information, or perform other actions on such Linked Sites. It is acknowledged that the Company has no knowledge, control, or responsibility over the content or operations of such Linked Sites. Submission of information or registration on such Linked Sites is not subject to the Company’s Privacy Policy but to the Privacy Policy of those Linked Sites and applicable law. Browsing such Linked Sites, as well as any other actions performed by the user in connection therewith, shall be the sole responsibility of the user and the owners of the Linked Sites. The user hereby expressly waives any claim or demand for any direct or indirect loss or damage against the Company and/or its representatives arising from reliance on or use of the content or information provided on such Linked Sites.
Continuous use of the Website depends, among other things, on the availability, integrity, and reliability of the Internet network and/or, as applicable, wired or cellular communication networks, which, as is known, may not always be complete or continuous in certain times or regions. The Company and/or its representatives shall not be liable for any loss, expense, damage, including special, consequential, or indirect damages, resulting from the operation or non-operation of the Website, including but not limited to errors, malfunctions, or technical failures in viewing information.
The Website may contain inaccuracies, typographical errors, and other mistakes, and it is not possible to prevent errors, defects, or mistakes in the content or the manner in which it is transmitted.
Communication networks, computers, servers, and websites are exposed to attacks and hacking attempts by various parties. The Company implements multiple security measures to protect the privacy of information submitted through the use of the Website; however, users acknowledge that complete security cannot be guaranteed, and breaches or unauthorized intrusions may occur. The Company does not warrant that the Website will be completely immune from unauthorized access to stored information. By accessing the Website and submitting user information, the user releases the Company and/or its representatives from any liability for any damage incurred by the user or any person on their behalf as a result of attacks, hacking attempts, or unauthorized intrusions, and waives any claims against the Company and/or its representatives in this regard.

Miscellaneous

The Company reserves the right, at its sole discretion, to add, modify, remove, or replace any or all provisions of the Terms of Use at any time without prior consent from users, by publishing notice on the Website. The binding version of the Terms of Use shall be the version appearing on the Website from time to time. It is the user’s responsibility to review changes, if any, to the Terms of Use. Any disputes, claims, or actions arising in connection with the Website, including, without limitation, in connection with the information and content contained therein, shall be governed by the laws of the State of Israel. The courts of Tel Aviv-Yafo shall have exclusive jurisdiction over all matters relating to the Terms of Use and the use of the Website, and the parties expressly waive the jurisdiction of any other court.
If any provision of the Terms of Use is determined by a court of competent jurisdiction to be illegal or invalid, such determination shall not affect the validity or enforceability of the remaining provisions or any part of such provision not deemed illegal or invalid.
Any delay by the Company in exercising a right or failure to enforce a right under the Terms of Use or by law shall be without prejudice and shall not constitute a waiver of such right.
